Clear Capital Markets Limited (“the Firm”, “we”, “us”, or “our”) is the data controller responsible for yourpersonal data. This Privacy Notice explains how we collect, use, share, and protect your personalinformation.

- When you complete account opening forms or provide supporting documents (such as identification or proof of residence).
- When you access and trade on your account via the custodian’s platform.
- When you correspond with us by phone, email, or other communication channels.

This information may include your name, contact details (email, phone, address), financial information (income, wealth), identification numbers (e.g., National Insurance), date of birth, employment and professional details, trading history, and records of products or services you use or are interested in.

b. Information from Other Sources

We may also collect personal data about you from:

- Public sources such as Companies House or the Electoral Register.
- Third parties, including credit reference or fraud prevention agencies, or financial intermediaries acting on your behalf.

c. Monitoring of Communications and Account Activity

Subject to applicable laws, we may monitor and record communications with us, including calls, emails,social media messages, and other interactions. We do this for:

- Regulatory compliance and legal obligations.
- Crime prevention and detection.
- Security of our systems and communications.
- Quality control, staff training, and providing you with records of communications on request.

We may also monitor activity on your account for similar purposes. These activities are justified under our legitimate interests or legal obligations and are conducted in accordance with applicable laws, including FCA rules and UK GDPR.

2. Why we collect your information

The Firm collects your personal information in order to provide you with our products and services, toestablish and manage your account and to comply with the law. By collecting your information, the Firmis able to monitor and improve the services we offer to our existing and potential clients.

3. How we use your information

We process your personal data only when there is a valid legal basis under Data Protection law. This mayinclude:

- Performance of a contract – to deliver the services you have requested and manage your account.
- Legitimate interests – for purposes such as governance, analytics, fraud prevention, marketing, and improving our services.

Technical website data processing (behavioural signals, device characteristics, advertising click identifiers) is conducted under our legitimate interests for fraud prevention and service improvement, this data cannot directly identify you and is subject to retention limits.

c. Marketing, Research, and Analysis

- Sending information about our products, services, and relevant opportunities.
- Conducting market research, analytics, and developing anonymized statistical data, which may beshared with other companies but cannot personally identify you.
- Improving and developing new services.
- Requesting feedback on our services.

- Other account holders or connected parties – for example, individuals named on your application.
- Authorities or parties required by law – including disclosures necessary under legal or regulatory obligations.
- International transfers – any sharing outside the UK or EEA is protected by adequacy decisions, Standard Contractual Clauses (SCCs), or other approved safeguards.

We do not sell your personal information to third parties for marketing purposes. Any external organisation handling your data is required to respect confidentiality, comply with relevant Data Protection laws, and uphold your privacy rights.

5. What rights do you have?

Your rights are as follows in respect of the personal information we hold about you:

- The right to be informed about processing of your personal data.
- The right to have your personal data corrected if it is inaccurate and to have incomplete personal data completed.
-The right to object to processing of your personal data.
- The right to restrict processing of your personal data.
- The right to have your personal data erased.
- The right to request access to a copy of your personal data and information about how we process it. Please make all requests for access in writing (see how to contact us for details) and provide us with evidence of your identity.
- The right to move, copy or transfer your personal data.
- You have rights in relation to automated decision-making, including the right to request human intervention and to contest decisions.
- You have the right to lodge a complaint with the Information Commissioner’s Office (www.ico.org.uk) if you believe your data has been handled unlawfully.

Please note, some of these rights only apply in certain circumstances and we may not be able to fulfil every request.

6. How we protect your information

The Firm is committed to protecting the privacy of all personal information that we obtain from you.

We continue to adopt industry and information security best practices to protect your personal information and ensure that unauthorised persons cannot access it. Measures include encryption of data during transmission, strong authentication mechanisms, cybersecurity processes and secure access to machines and data.

We train our employees who handle personal information to respect the confidentiality of customer data and the privacy of individuals.

7. How we protect your information in data transfers

We may transfer personal information to other countries outside of the UK and European Economic Area. In such circumstances, we will ensure that any international transfers of personal data are lawful and subject to appropriate safeguards, including adequacy decisions, Standard Contractual Clauses (SCCs), or other approved mechanisms

8. How you can protect your information

Just as at the Firm, you should care about the security of your personal data. Do not give your security details to log in to your account, such as passwords or passcodes, to anyone else. If you feel someone may have gained knowledge of your login details, please contact the Firm so we can support you and protect you and your information.

Additionally, we recommend securing your devices with a password or passcode

9. How long we hold your information

We keep your personal information only as long as necessary to provide our services, meet legal or regulatory requirements, and maintain proper business records. In general, this means your data is securely deleted or anonymized at least five years after the end of our relationship with you.

In some cases, we may retain information for longer where required by law, regulation, or contractual obligations. All deletion or anonymization is carried out in line with the Firm’s internal Record Keeping Policy.

You also have the right to lodge a complaint with the Information Commissioner’s Office (www.ico.org.uk) if you believe your data has been handled unlawfully.

11. Changes to our Privacy Policy

The Firm may change this Privacy Notice from time to time. When such a change is made, we will post are vised version online. Changes will be effective from the point at which they are posted. It is your responsibility to review this Privacy Notice periodically, so you are aware of any changes. By using our services, you agree to this Privacy Notice.
